Terms of Service

1. Introduction and Acceptance

Welcome to Renovation Insight (the "App"), provided by Webisity Studio ("we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Webisity Studio governing your access to and use of the Renovation Insight mobile application.

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

2.2 Account Creation

To access certain features of the App, you must create an account by providing accurate and complete information, including a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

2.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.

3. Description of Service

Renovation Insight is a mobile application that analyzes residential renovation walkthrough videos using artificial intelligence technology. The service workflow includes:

1. Video Upload: Users record or upload renovation walkthrough videos
2. Keyframe Extraction: The App extracts representative still images (keyframes) from your video on your device
3. AI Analysis: Keyframes are sent to Google Gemini AI for analysis
4. Report Generation: The App generates a structured report including:
   • Renovation stage assessment
   • Area-by-area status breakdown
   • Identification of high-leverage risks (sequencing, quality, safety, coordination, materials, timeline)
   • Questions to ask your contractor
   • Requests for additional visual evidence

4. License Grant and Restrictions

4.1 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial purposes.

4.2 Restrictions

You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Modify, adapt, translate, or create derivative works based on the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
• Use the App for any illegal, harmful, or unauthorized purpose
• Rent, lease, sell, sublicense, distribute, or otherwise transfer rights to the App
• Use automated systems (bots, scrapers) to access the App
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of the App
• Use the App to upload malicious content or code
• Impersonate any person or entity or misrepresent your affiliation

5. User Content and Data

5.1 Your Video Content

When you upload videos to the App, you retain ownership of your original content. However, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and analyze your videos and extracted keyframes for the purpose of providing the service and improving our AI models.

5.2 Data Processing

By using the App, you acknowledge and agree that:

• Videos are temporarily stored on our servers (Supabase Storage)
• Keyframes are extracted from your video on your device
• Keyframes are sent to Google Gemini AI for analysis (third-party service)
• Analysis reports are stored in our database
• Audio from videos is NOT processed or analyzed

5.3 Content Responsibilities

You are solely responsible for the content you upload and represent that:

• You have all necessary rights and permissions to upload the content
• Your content does not violate any laws or third-party rights
• Your content does not contain private information about others without consent
• Your content does not contain malicious code or harmful materials

5.4 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

6. Subscription Plans and Billing

6.1 Service Plans

Renovation Insight offers multiple service tiers:

• Free Tier: Limited monthly analysis quota
• Paid Subscriptions: Starter and Pro plans with increased quotas
• Add-on Credits: Additional analyses available for purchase

6.2 Billing and Payment

Paid subscriptions are processed through RevenueCat and your device's app store (Apple App Store or Google Play Store). By subscribing, you agree to:

• Pay all applicable subscription fees and taxes
• Provide accurate payment information
• Authorization for recurring charges at your selected billing interval
• App store terms and conditions governing in-app purchases

6.3 Subscription Renewal and Cancellation

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your app store account settings. Cancellations take effect at the end of the current billing period.

6.4 Refunds

Refund requests must be submitted through your app store (Apple App Store or Google Play Store) according to their respective refund policies. We do not directly process refunds for in-app purchases.

6.5 Usage Quotas

Each plan includes a monthly analysis quota. Exceeding your quota requires purchasing add-on credits or upgrading your plan. Unused quotas do not roll over to subsequent months.

7. Intellectual Property Rights

7.1 Our Property

The App, including all software, code, algorithms, designs, graphics, interfaces, trademarks, and logos, is owned by Webisity Studio and protected by intellectual property laws. All rights not expressly granted are reserved.

7.2 Trademarks

"Renovation Insight" and associated logos are trademarks of Webisity Studio. You may not use our trademarks without prior written permission.

7.3 Generated Reports

AI-generated analysis reports are created using your video content and our proprietary AI technology. You receive a license to use these reports for your personal purposes, but we retain rights to the underlying technology and methodology.

8. Disclaimers and Limitations

8.2 AI Limitations

Our AI analysis cannot and does not:

• Assess hidden conditions (behind walls, under floors, above ceilings)
• Verify building code compliance
• Evaluate structural integrity or load-bearing capacity
• Assess electrical, plumbing, or HVAC system safety or functionality
• Detect hazardous materials (asbestos, lead, mold)
• Provide cost estimates or project timelines
• Replace on-site professional inspection

8.3 Service "As Is"

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.4 Accuracy Disclaimer

While we strive for accuracy, we do not warrant that:

• AI analysis will be accurate, complete, or error-free
• The App will be uninterrupted, timely, or secure
• Results will meet your expectations or requirements
• Errors or defects will be corrected

8.5 Third-Party Services

Our App uses Google Gemini AI (a third-party service) for analysis. We are not responsible for the performance, accuracy, or availability of third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or use
• Property damage or personal injury
• Renovation defects, delays, or cost overruns
• Decisions made based on AI-generated reports
• Contractor disputes or legal issues
• Building code violations or permit problems
• Structural failures or safety issues

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Webisity Studio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the App
• Decisions you make based on AI-generated reports

11. Account Termination

11.1 Termination by You

You may delete your account at any time through the App settings. Upon deletion:

• Your access to the App will be terminated
• Your data will be deleted according to our Privacy Policy
• Active subscriptions remain subject to app store cancellation policies

11.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or misuse the App
• Fail to pay applicable fees
• Pose a security risk to our systems or other users

11.3 Effect of Termination

Upon termination, your license to use the App immediately ceases. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply.

12. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, available at:

By using the App, you consent to our Privacy Policy and acknowledge that:

• Your video keyframes are sent to Google Gemini AI for analysis
• Analysis data is stored in our Supabase database
• We implement row-level security and encryption to protect your data
• You can request data deletion by contacting us

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Negotiation: Contact us first to resolve disputes informally
2. Mediation: If informal resolution fails, disputes may be submitted to mediation
3. Jurisdiction: If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you via email or in-app notification
• Require your acceptance of updated Terms before continued use

Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and delete your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Webisity Studio regarding the App and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, internet outages, or third-party service failures.

You agree to comply with all applicable export and import laws and regulations regarding the App.
